As per the Delaware Divorce law one should have resided in the state for at least 6 months;

also both the spouse should be living separately.

No matter, even if you are living in the same house you should not share the same bedroom for at least a month prior filing divorce case.

  • In Delaware the court shall enter a decree of divorce whenever it finds that

the marriage is irretrievably broken and that reconciliation is doubtful.

  •  As per the divorce law, a bonding is irrecoverable broken where it is

characterized by any voluntary separation caused by respondent’s misconduct.

  • According to the court, this can also occur when the separation is caused by

respondent’s mental illness or separation caused by incompatibility.
