Section 4.2-13m Material breach of contract of Civil Jury Instructions of Connecticut deals with the breach of contracts cases arising from commercial transactions.

  • As per the Jury instructions, a material breach is one where the aggrieved party is deprived of substantial benefit that was expected to be delivered by the other party to the contract.
  • The court will consider the extent to which the party was deprived of benefits or the extent of damages suffered in order to determine the amount of compensation.
  • The future performance of the contract and the extent to which the contract performance is possible will also be verified by the Court.
