Breach of contracts in Tennessee refers to failed contractual promises forming part of legally enforceable contracts.

  • There are two kinds of damages recognized by Tennessee courts arising from breach of contract: expectation damages and reliance damages.
  • Expectation damages will reinstate the aggrieved party the same position as it was before the contract. Reliance damages most probably lead to monetary compensation equal or less than the amount of loss incurred.
  • Expectation damages are most preferred since they are easy to seek for and are sure of being rewarded. In case of a bankrupt contractor getting financial reimbursement will take a long time which may not be desirable in all cases.
