State law does not provide the right of redemption or deficiency judgments to borrowers.

  • The judicial foreclosure requires a lawsuit filed in court, which the court will inquire about before the foreclosure gives to the lender.
  • The non-judicial foreclosure is valid only when the Deed of trust or mortgage does not have the power of sale clause. In such cases, the property will auction off to the highest bidder.
  • The lender can transfer the power to sell the property to his legal or heir or representative.
