Spousal support is the allowance paid by the higher earning spouse to the low earning one as a decree in pre or post divorce.
There are two types of Spousal support in Louisiana.
Interim spousal support:
This provided when the final spousal support is still in pending.
This is generally offered to prevent unnecessary economic disturbance until the determination of the final support amount.
This can terminate with the final judgment of divorce or determination of final spousal support.
Final Spousal support:
This considers the needs of the claimant and the ability of the other spouse to pay.
Also the financial obligations, earning capacities of the parties are considered and rehabilitative support can be given as a part of Final spousal support.
