Washington courts classify a failure to perform a duty under the contract without a legal excuse as a breach of contract.

  • The breach is classified as material or total and simple or partial. A material breach is one which fails the central purpose of the contract as a whole.
  • Under a simple breach of contract, the contract does not come to an end, but the aggrieved party is given a right to seek legal remedy for damages incurred.
  • The damage will be computed taking into account the worth of damages that occurred incidentally and consequently to the contract.
