HomeArkansas ForeclosureArkansas Foreclosure Law

The Arkansas Foreclosure laws give lenders two options, judicial and non-judicial foreclosure.

  • Before executing the foreclosure under either of the options, an appraisal of the property has to carry out.
  • A foreclosure of a property bound by a Deed of Trust or Mortgage should sell for less than two-thirds of its appraised value.
  • Under judicial foreclosure, the court releases a decree of the borrower’s liability to be repaid within a specific timeframe failing to which the court clerk as commissioner will advertise the property for sale.
