Indiana DUI/DWI laws and the penalties following the convictions are often pretty complicated.
An individual can charge as either Felony or Misdemeanor following the severity of the offense.
- Implied consent law: If an individual in Indiana drives a vehicle, s/he can be subjected to a chemical test to check the alcohol consumption and drug intoxication levels. Refusal to the test is a breach of law, and so is an offense.
- Habitual Offender law: If an individual convicts on consecutive DUI/DWI charges, the court regards them as a habitual offender.
- No wet reckless: In Indiana, a DUI offense cannot bargain as a conviction of wet reckless.
