DUI/DWI laws and the penalties following the convictions in Indiana are often pretty complicated. An individual can be charged as either Felony or Misdemeanor following the severity of the offense.
- Implied consent law: if an individual in Indiana drives a vehicle, s/he can be subjected to chemical test to check the alcohol consumption and drug intoxication levels. Refusal to the test is a breach of law and so is an offense.
- Habitual Offender law: if an individual is convicted on consecutive DUI/DWI charges, then the court regards them as habitual offenders.
- No wet reckless: In Indiana, a DUI offense cannot be bargained as a conviction of wet reckless.
