Kansas Foreclosure Laws forbid the option of non-judicial foreclosure and issues foreclosure of property only under the judicial route.

  • The law recognizes the Mortgage agreement as the primary security instrument which enables the lender to claim for his dues from defaulting borrower or property owner.
  • The foreclosure laws provide for right of redemption and deficiency judgments.
  • The lender can sell the property once the court issues the foreclosure. However, the lender has to publicize about the property sale, a notice of which should also be served to borrower within five days from the first advertisement.
